The Sri Lanka Freedom Party Women's Wing has filed a petition before the Supreme Court seeking a decision declaring the proposed 22nd Amendment to the Constitution unconstitutional. The petition was filed by Attorney-at-Law Anuradha Lakmini Guruge, Secretary of the Sri Lanka Freedom Party Women's Wing.
She states in the petition that certain clauses of the proposed amendment may directly affect judges currently serving in office, which may affect the independence of the judiciary, the separation of powers and the institutional checks and balances system. The petitioner also states that this amendment has been introduced without adequate public consultation and without sufficient transparency.
The Sri Lanka Freedom Party Women's Forum requests the Supreme Court to rule that the proposed changes may have a direct adverse impact on the sovereignty of the people guaranteed under Article 3 of the Constitution, as well as the inalienable sovereignty vested in the people under Article 4(c), and therefore the proposed 22nd Amendment must also obtain the direct approval of the people through a referendum.
